Frequently Asked Questions Regarding Annual Reporting Requirements For Telecommunications Providers
(OPUC Form C, Form L, And Form O)

Q1. Who is a "telecommunications provider"?
 
A telecommunications provider or telecommunications carrier may be a competitive provider, competitive local exchange carrier (CLEC), incumbent local exchange carrier (ILEC), interexchange carrier (IXC), shared service provider, reseller, telecommunications utility, telecommunications cooperative, or telecommunications association. APPLICABLE LAWS, RULES, AND ORDERS
 
Q2. What laws apply to OPUC´s jurisdiction over telecommunications providers?
 
Most Oregon Revised Statutes (ORS) related to OPUC and telecommunications providers are in ORS Chapters 183, 192, 469, 756, 758, 759, and 772. Copies of all ORSs are available from Oregon.gov at http://www.oregon.gov.
 
Q3. What rules apply to OPUC and telecommunications providers?
 
Most Oregon Administrative Rules (OARs) related to OPUC and telecommunications providers are in OAR Chapters 860 and 952. OPUC´s rules for telecommunications utilities are in OAR Chapter 860, Divisions 011 through 035. Most OPUC rules for competitive providers and competitive local exchange carriers are in OAR Chapter 860, Division 032. Most OPUC rules for telecommunications cooperatives are in OAR Chapter 860, Division 034. ANNUAL REPORTS REQUIRED 
 
Q5. What annual reports must be filed by telecommunications providers?
 
Two completed annual reports are due.
 
Each telecommunications provider must file a Gross Revenue Fee Statement for Telecommunications Providers (Annual Fee Statement).
 
In addition, each telecommunications provider must file one of the following reports each year:
  • Form C, Annual Report for Competitive Providers;
  • Form L, Annual Report for Local Exchange Carriers; or
  • Form O, Annual Report for Telecommunications Utilities and Cooperatives.
 
Q6. When are the annual reports due?
 
All annual reports are due by April 1 each year.
 
Q7. What is the penalty for failing to complete and file the prescribed annual reports by April 1?
 
If OPUC has not received the completed and signed annual reports by April 1, OPUC may begin the process to cancel the provider´s certificate(s) of authority to operate in Oregon (OAR 860-032-0008).
 
Q8. If a telecommunications provider did not have any revenues during the year, must it file any annual reports?
 
Yes. An Annual Fee Statement and Form C, L, or O are due from the telecommunications provider as a condition of keeping its certificate of authority. A minimum of $100 gross revenue fee is also due, even if the telecommunications provider did not have any revenues during the year.
 
Q9. If a telecommunications provider has more than one certificate of authority, must it file separate reports (Annual Fee Statement, Forms C, L, and O)?
 
If a legal entity holds more than one certificate, it should file one Annual Fee Statement and one Form C, L, or O. Each legal entity must file separate annual reports. For example, if a telecommunications provider offers interexchange and intraexchange services, it should file one Form L and one Annual Fee Statement. However, if the provider offers telecommunications services through separate subsidiaries, it should file separate forms and pay separate OPUC fees for each legal entity.
 
Q10. When will OPUC´s web site be updated with the current annual report forms?
 
OPUC plans to put the current annual report forms and instructions on the web site by December 31 each year. 
  
 
FORM C, ANNUAL REPORT FOR COMPETITIVE PROVIDERS
 
Q11. Who must file OPUC Form C?
 
Each telecommunications provider that only has a certificate of authority to provide interexchange service in Oregon under Oregon Revised Statute 759.020 (that is, not a utility, cooperative, association, or CLEC) must complete and file the Annual Report for Competitive Providers (Form C). See Oregon Administrative Rules 860-032-0012 and 860-032-0060. 
  
 
FORM L, ANNUAL REPORT FOR LOCAL EXCHANGE CARRIERS
 
Q12. Who must file OPUC Form L?
 
Each CLEC must complete and file the Annual Report for Local Exchange Carriers (Form L). See Order 98-506, OAR 860-032-0012, and OAR 860-032-0060. Form L includes the information required in Form C. 
  
 
FORM  O, ANNUAL REPORT FOR TELECOMMUNICATIONS UTILITIES AND COOPERATIVES
 
Q13. Who must file OPUC Form O?
 
Each incumbent LEC (telecommunications utility, cooperative, and association) must complete and file the Annual Report for Telecommunications Utilities and Cooperatives (Form O). See OARs 860-027-0070, 860-032-0012, 860-032-0060, 860-034-0395, and 860-034-0750. Form O includes the information required in Forms C and L.
 
Q14.  Must ILECs file Form C if the company has competitive operations?
 
No; however see the instructions to Schedule CP.
 
Q15.  Must ILECs file Form L?
 
No; however see the instructions to Schedule LEC. 
  
 
Annual Fee Statement
 
Q16. Who must file an Annual Fee Statement?
 
Each telecommunications provider that has a certificate of authority under Oregon Revised Statutes (ORS) 759.020, 759.025(1), or 759.050 at any time during the year must file an Annual Fee Statement and pay the annual fee under ORSs 756.310, 756.320, and 756.350. The Annual Fee Statement applies to everyone except commercial mobile radio service (CMRS), radio common carriers (RCCs), and telecommunications cooperatives with operations certified only under ORS 759.025(2). GETTING THE FORMS AND INSTRUCTIONS
 
Q17. How can I get copies of the forms and instructions?
 
The forms (Excel format) and instructions (Adobe Acrobat format) are available at OPUC´s web site under Telecommunications and Revenue Fee Statement. 
  
 
COMPLETING THE FORMS
 
Q18. May I substitute other reports, if the other reports provide the same or similar data as the Annual Fee Statement or Forms C, L, or O?
 
No substitutions are acceptable for the Annual Fee Statement or Forms C or L. Only a few substitutions are acceptable for certain schedules in Form O, as indicated in the instructions.
 
Q19. Where can I find the docket number in which the respondent’s certificate of authority was granted?
 
OPUC docket numbers are listed by telecommunications provider on OPUC´s web site under Telecommunications, Telecommunications Providers, Utility Company Search Page.
 
Q20. Where can I find the respondent’s "company identification number"?
 
Telecommunications company ID numbers are available by telecommunications provider in eDockets or on OPUC´s web site under Telecommunications, Telecommunications Providers, and Utility Company Search Page.
 
Q21. For Forms C and L, how do I know which boxes to check in Part E?
 
The certificate of authority lists the services the telecommunications provider is authorized to provide in Oregon.
 
Q22. If a competitive provider or CLEC uses OPUC´s Excel file to complete Form C or L, may it file an electronic copy?
 
No. The telecommunications provider must provide a completed and signed paper copy of Form C or L to OPUC by April 1. This will ensure proper credit and distribution of the form.
 
Q23. If a telecommunications utility or cooperative uses OPUC´s Excel file to complete Form O, may it file an electronic copy?
 
Yes. However, the company must also provide one completed and signed paper copy of Form O to OPUC by April 1. This will ensure proper credit and distribution of the form. 
  
Q24. Once I have used the Excel file to complete the Form C, may I change the date for next year and resubmit the form?
 
The competitive provider may edit last year´s Excel file as needed and reprint it. Parts A, B, D, and E may not have changed. But Part C must be signed and dated. And, Part F contains year-end data that might have changed. 
  
 
CONFIDENTIAL INFORMATION
 
Q25. Will the information reported in the annual reports be treated as confidential?
 
The following schedules contain data that are exempt from public disclosure as trade secrets and will be treated as confidential subject to Oregon Revised Statute Chapter 192:
  • Form C, Part F.
  • Annual Fee Statement, all dollar amounts.
  • Form L, Parts F through K.
  • Form O, Schedule S-2; Schedule CP, Part F; and Schedule LEC, Parts F through K.
